Terms and Conditions
You agree to the terms outlined below by using Alabama Estimating services. Unless replaced by a signed and written agreement, these terms apply to all transactions.
General Conditions
These terms take precedence over any earlier agreements unless specifically modified in writing.
Definitions
- Client: The person or organization using Alabama Estimating’s services.
- Provider: Alabama Estimating.
- Services: Tasks the Provider provides, such as estimating, consulting, or similar activities.
- Initial Work: Early stages of a project or any third-party services needed to begin.
- Digital Files: Any computer files shared during the work process.
- Intellectual Property: Ownership rights related to creations from the Services.
Orders and Delivery
When you confirm an order, it means you agree to these terms. Deliveries are provided electronically, and clients are responsible for storing and distributing these files. Regardless of the cause, delivery delays do not remove your obligation to pay. Partial deliveries may happen, and each segment will be billed individually. Future work may be paused if payments are not made on time.
Payments and Fees
Costs may change if the scope of work is adjusted. Clients are responsible for any taxes related to the Services. Fees for Initial Work remain due even if the project is cancelled. Payments are expected in advance unless otherwise agreed upon. If the Client causes mistakes or delays, additional charges may be applied.
Credit Terms
Credit-based customers must make payments within 30 days of receiving the invoice. Late payments will incur interest. The Provider reserves the right to cancel credit terms at any time.
Materials Provided by the Client
Clients are advised to maintain backups of any materials they supply. The client must ensure the accuracy of the provided materials, and unsuitable materials may be denied, resulting in delays or additional charges. Any materials stored by the Provider are at the client’s risk.
Materials Provided by the Provider
Materials shared by Alabama Estimating remain the Provider’s property unless specifically transferred to the Client. Non-digital materials may be discarded once the project is complete unless agreed otherwise. Data generated by machines will not be shared unless previously discussed.
Work Review and Approval
Clients must check and approve drafts or previews provided. Any mistakes not corrected at this stage will become the Client’s responsibility. If changes are needed after approval, additional fees will apply. Minor differences in color or output are not considered errors for liability purposes.
Risk and Insurance
Clients are advised to arrange insurance for risks related to handling, storage, or delivery of materials.
Work Approval Window
Clients must report any problems within 4 hours of receiving the finalized work. If no issues are reported, the work is considered accepted.
Limitation of Liability
The Provider will not be responsible for indirect damages, such as loss of profit. Any financial claims are limited to the amount paid for the specific service.
Cancellation Policies
Orders may only be cancelled before work begins. The client will need to pay any expenses incurred up to that point, along with possible additional charges.
Ownership and Payment Rights
Alabama Estimating owns any work until payment is made in full. If payment is not completed, the Provider has the right to recover the delivered work.
Restricted Content
The Provider may decline any project involving illegal or objectionable content. Clients agree to take responsibility for any legal issues related to the content they supply for projects.
Uncontrollable Delays (Force Majeure)
The Provider is not responsible for delays caused by circumstances beyond their control, such as natural disasters or strikes.
Governing Law
All disputes will be handled under U.S. law and in U.S. courts.
Details on Estimating Services
To prevent delays, clients must provide clear guidelines and respond to requests promptly. The Provider owns the completed work, but the Client may use it for marketing or promotional purposes.
Data Privacy
Clients must ensure they have the rights to any personal data they provide. Any personal data shared will be deleted after the project complies with applicable laws.
